Canada: The Temporary Foreign Worker Program Solutions Road Map

The government of Canada introduced the Temporary Foreign Worker Program workforce solutions road map and its five phases to address labour shortages throughout the country.

On 4 April 2022, the government of Canada announced the Temporary Foreign Worker (TFW) program workforce solutions Road Map.

 

The recently announced Temporary Foreign Worker Program (TFWP) Workforce Solutions Road Map introduces improvements to the TFWP to address labour shortages throughout the country. Under the Road Map, the government aims to address labour shortages throughout the country, enhance worker protections, and provide new pathways to permanent residency. Over the coming weeks, the Canada Immigration Services planned to implement fundamental policy changes.

 

New Changes in the Canada Immigration:

 

1. Address seasonal immigration peaks by removing limits on the number of lower-wage positions employers in seasonal industries can fill through the TFW Program, making the Seasonal Cap Exemption permanent.

 

2. The maximum duration of lower-wage positions in seasonal industries will also be increased from 180 days to 270 days per year.

 

3. Increase the validity of Labour Market Impact Assessments (LMIAs) from nine months to 18 months.

 

4. Extend the maximum duration of employment of High-Wage and Global Talent Streams workers from two years to three years.

 

5. Allow employers from sectors with demonstrated labour shortages to hire up to 30 percent of their workforce through the TFW Program for lower-wage positions for one year.

 

6. In sectors that do not demonstrate labour shortages, allow all other employers to hire up to 20 per cent of their workforce through the TFW Program for lower-wage positions.

 

7. End all current policies that automatically refuse LMIA applications for lower-wage occupations in the accommodation, food services and retail trade sectors in regions where unemployment is at six per cent or higher.

 

The federal government took an essential step in giving workers access to 10 paid days of sick leave through the Canada Recovery Sickness Benefit (CRSB), but the provinces need to step up and create their own paid sick days.

 

Of course, one of the best ways to improve working conditions and combat inequities like pay gaps is to give workers a voice in the workplace through unionization. Since the pandemic, there has been a growing number of workers who have reached out to unions or who have started organizing in their workplace.

They include further strengthening TFW inspection tools and mandatory training and leveraging its tip line, allowing workers to flag any situation of abuse or misuse of the program. Expanding its work with consulates to identify concerns that need immediate attention.
